In compliance with state housing law, the Town of Danville adopted its 2023-2031 Housing Element, which has been submitted to the State of California for review and certification. State law mandates communities throughout California--including Danville--to accommodate a greater number of higher density multi-family housing units, including sites that were previously designated for other types of uses in the Danville 2030 General Plan. The Town's role is not to construct housing but to identify where and how Danville will accommodate the state-assigned units for people of all income groups. For the upcoming 2023-2031 planning period, the Town is expected to accommodate a minimum of 2,241 new homes.

The Housing Element update has been developed following a lengthy public process including inviting the community to identify suggested housing sites, evaluate housing plan simulations, and presentation of the proposed Housing Element update at Planning Commission and Town Council public hearings.

Many recent changes to State law have significantly eroded local control over housing development and increased the severity of penalties for non-compliance. Securing the State's certification of the Housing Element ensures that Danville remains eligible for state funding and avoid fines of up to $600,000 per month. Most importantly, a compliant Housing Element avoids potential lawsuits, with consequences that include court mandated compliance, court suspension of local control over building permits, and court approval of housing development on the Town's half.

Concerns about the impacts of state legislation are most effectively expressed directly to our State legislators, who are: Senate Steve Glazer and Assemblymember Rebecca Bauer-Kahan.

    The Town of Danville adopted its 2023-2031 General Plan Housing Element on January 17, 2023, and submitted it to the State Department of Housing and Community Development (HCD) before the statuary deadline, on January 31, 2023. HCD is required to review and determine if the Housing Element meets all requirements of State Housing law within 60 days.

    Danville, along with the vast majorities of cities and counties, has since received a comment letter from HCD. In its letter, the State determined that Danville’s Housing Element met many, but not all, of the statutory requirements. Specifically, HCD believes that many of the Town’s housing development standards – particularly those associated with height and parking requirements - must be less restrictive. The Town is working to address the comments received, with the goal of re-submitting to HCD by the end of summer.

    As a reminder, for the upcoming 2023-2031 planning period, the Town is expected to accommodate 2,241 new homes, regardless of available land capacity. To date, just 15 cities out of the 101 cities and 9 counties in the San Francisco Bay Area have a State-certified Housing Element.

    At its January 17, 2023 Special Meeting, after considering public testimony and follow-up questions, the Town Council unanimously approved the Draft 2023-2031 Housing Element, Final Programmatic EIR, and the first reading of the zoning text amendments as proposed.

    The Town is on track to submit the Final Danville 2023-2031 Housing Element to State-HCD on January 31, 2023.

    At its December 13, 2022 public hearing, after considering public testimony and follow-up questions, unanimously recommended that the Town Council consider the Draft Housing Element, Final Programmatic EIR, and all associated actions as proposed.

    The Town Council is scheduled to consider this item at a Special Meeting on Tuesday, January 17, 2023 at 5:00 PM. The meeting will occur in person at a Danville community facility to be determined.

    The Final Programmatic Environmental Impact Report (Final PEIR) related to the Town’s Draft 2023-2031 Housing Element is now available for public review. In conformance with the California Environmental Quality Act (CEQA) and CEQA Guidelines, this Final PEIR includes comments received during the public review period for the Draft PEIR as well as responses to those comments.

    The Danville Planning Commission, at its December 13, 2022 public hearing (via teleconference), will review and consider the Final PEIR as part of its 2023-2031 Housing Element adoption process.     The Draft Programmatic Environmental Impact Report (DPEIR) related to the Town’s draft 2023-2031 Housing Element is now available for public review. The DPEIR studies potential environmental impacts related to the implementation of the Housing Element, which includes potential General Plan land use amendment to provide for the Town’s assigned Regional Housing Needs Allocation (RNNA) as required under State Law. The public review period for the DPEIR runs from September 13, 2022 ,through October 28, 2022. A public hearing will be held by the Planning Commission on September 27, 2022, to allow for oral comments on the adequacy of the DPEIR. Any comments you may have may be forwarded to David Crompton, Chief of Planning at dcrompton@danville.ca.gov . All comments received will be responded to in writing as part of the Final EIR which will be prepared at the end of the public review period.
